International litigation

International disputes require specialist legal advice because of the complexities involved in cross-border litigation.

It is usual to have a clause in a contract or agreement stipulating which jurisdiction a dispute will be resolved under, for example, the courts of England and Wales. Although in some cases, a party may prefer to have a matter resolved in their own country. This may be because of the costs involved – or because a court hearing in a particular jurisdiction might be advantageous legally.

In any case involving cross-border disputes or international law, it is crucial to seek legal advice as soon as possible.

If any dispute is not brought to the attention of the other party immediately, a court may also decide that continuing to comply with the terms of a contract or the actions of one party under the contract constitute agreement to the contract or the way it has been enacted.
